• Each file includes personal and SMALL BUSINESS commercial use up to 500 uses.

• SMALL BUSINESS means that the buyer must be the only person that uses the file and completes the final product (shirt, bag, mug etc)

• The buyer may NOT under any circumstances use any design or any part of a design to create a new design you intend to sell in any digital format. 

You are NEVER allowed to sell, share, give away, or trade our designs.

• All designs sold by Scarlett Rose Designs can only be used as their original intended purpose. Therefore, they may NOT be digitized into embroidery designs for personal use or resale purposes. 

• PLEASE download your designs at the time of purchase. The site is not meant to be a storage device for the designs you purchase. It is your responsibility to download them and save them for future use.

Allowed With Our Extended License (COMING SOON)

• Use on products created physically by you. Includes (but not limited to) shirts, hats, mugs, signs, and posters. Selling sublimation transfer sheets, printable vinyl decals, and similar items, so that your buyer can create their own physical products.
• The commercial usage extends to 1,000 uses (instead of 500) including physical products, and transfers.

Allowed With Our Corporate License (COMING SOON)

• Use any of our designs to upload to print on demand/POD websites like Amazon Merch, CafePress, Printiful and other POD sources. This involves using any of our design files to print on and sell products like shirts, hats, baby shirts, hoodies, sweatshirts, cups, mugs, etc. by order or mass production for re-sell or giveaway.

• Mass produce any of our designs on any medium (cloth, plastic, metal, etc.) by any manufacturing facility, domestic or international. This includes overseas China manufacturers who print and sell wholesale to boutiques and vendors in the US and other countries.

License for Free Items 

There are designs offered for free on our Site. Items downloaded for free may be used under the terms mentioned in this Agreement, with one exception: Each file includes a commercial use for up to 200 (not 500) uses.

Our Intellectual Property Rights

 All Items available on this site are protected by United States and international copyright laws and treaties. You acknowledge that all intellectual property rights of the designs belongs to Scarlett Rose Designs, that rights to the designs are licensed (not sold) to you, and that you have NO rights in, or to, the designs other than the right to use them in accordance with the terms of this Agreement. Copyrights to all designs remain Scarlett Rose Designs property.

You are NEVER allowed to sell, share, give away, or trade our designs.

 We take the protection of our intellectual property rights very seriously. If we discover that you have used our intellectual property in violation of this Agreement, we are entitled to bring legal proceedings against you. During such a proceeding, we have the right to seek monetary damages and/or an injunction to stop you using those materials. You could also be ordered to pay attorney’s fees.

 **Due to the increasing frequency of trademark registration applications and infringement allegations, you (THE PURCHASER) are responsible for researching trademarks on all items created to sell with our designs. You agree not to hold us responsible for any trademark infringements resulting from items you created with our designs. You can search trademarks on the USPTO government website. **
